There are two ways you can be arrested for driving under the influence in Gwinnett County. The first way is if your blood alcohol content is 08% or more. Keep in mind, this percentage has nothing to do with how intoxicated you may be. The second way is if the police officer had probable cause to believe you were a “less safe” driver as a result of alcohol. This may be the case even if your blood alcohol content is as low as .05%.
